REPORTING REQUIREMENTS

Chemical Inventory Annual Reporting Requirements for all LINDE CUSTOMERS WITH BULK STORAGE TANKS OR HIGH PRESSURE GAS TRAILERS CONTAINING OXYGEN, NITROGEN, ARGON, CARBON DIOXIDE, HYDROGEN, HELIUM, MAPP GAS, PROPYLENE, OR ACETYLENE.

At the request of the U.S. EPA, each year Linde reminds their customers of the Chemical Inventory annual reporting requirements of EPCRA (also known as SARA Title 3). Since 1990, letters were sent to our customers annually. Currently, a link to this website is listed on all applicable MSDS, purchase orders, and invoices. This website has been created to provide more information to help you complete this year's Chemical Inventory Report.

Tier II reports are due March 1 of each year to your local SERC and LEPC, and the fire department Since numerous States have their own reporting forms and requirements, we strongly recommend that you contact your applicable State Right-to-Know contact to determine specific requirements for your facilities. Blank Tier II Form and Instructions can be downloaded from the EPA webpage.


APPLICABLE FACILITIES
Each facility which stores 10,000 pounds or more at any one time of any hazardous substance (including the above) is required to submit a Chemical Inventory (Tier 2 Form) annually by March 1 to the Local Fire Department, Local Emergency Planning Commission, and State Emergency Response Commission. If you are storing other Extremely Hazardous Substances above their listed Threshold Planning Quantity, they also need to be reported. Certain exemptions do apply, including research and medical facilities (PDF 15 KB) if the substance is used under the direct supervision of a technically qualified individual (i.e doctors, nurses, research professionals). Additional guidance on completing the report pertaining to Hazard Category, Reporting Ranges, and Source Type and Conditions is also available. The reporting thresholds provided here are based on the Federal requirements. Some States many have lower reporting thresholds, and it is strongly recommended that you contact your applicable State Right-to-Know contact to determine appropriate reporting thresholds for your facilities.


ADDITIONAL INFORMATION
It is your responsibility as operator of the facility to comply with all reporting requirements under EPCRA. If you have customers to whom you lease bulk industrial gas storage vessels, we suggest you quickly notify them of the reporting requirements. If you have not already submitted a report, we urge that you do so immediately to comply with the law. The principal purpose of this law is to provide important information to the surrounding communities to help them plan for and respond to emergencies. Under EPCRA Section 325, penalties for non-compliance can range from $10,000 - $75,000 per violation or per day per violation if the reporting requirements are not met.
